1. Agreement to Terms

By accessing or using https://www.jayconstruction.com (the “Site”) and/or contracting our services, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our Site or services.

2. Scope of Services

J.A.Y. Construction LLC provides general contracting, roofing, additions, exterior and interior renovations, house lifting, and custom home construction services in New Jersey. Detailed service descriptions and project scopes will be set out in individual proposals and contracts.

3. Quotations and Estimates

All estimates provided are valid for 30 days from issuance unless otherwise noted. They are based on information available at the time; unforeseen conditions may require adjustments.

4. Contracts and Payments

• Deposit: A deposit (typically 10–30% of total) is due upon contract signing.
• Progress Payments: Interim payments are invoiced as project milestones are met.
• Final Payment: Due upon substantial completion and client acceptance.
• Late Payments: Invoices unpaid after 30 days may incur interest at 1.5% per month, plus collection costs.
• Change Orders: Any client-requested changes will be documented and may incur additional fees and schedule impacts.

5. Client Responsibilities

You agree to:

• Provide accurate project information and site access.
• Secure any necessary permits (unless otherwise agreed).
• Review and approve project plans and materials promptly.

6. Warranty and Disclaimers

• Workmanship Warranty: We warrant our workmanship for 1 year from completion.
• Manufacturer Warranties: Equipment and materials carry manufacturer warranties, and any claims should be directed to the manufacturer.
• Disclaimer: Except as stated above, all services and materials are provided “as is” without additional warranty, express or implied.

7. Limitation of Liability

To the maximum extent permitted by law, J.A.Y. Construction LLC’s total liability for any claim arising out of or relating to these Terms or services shall not exceed the total fees paid by you under the relevant contract.

8. Indemnification

You agree to indemnify, defend, and hold harmless J.A.Y. Construction LLC, its officers, and employees from any claims, damages, liabilities, or expenses arising out of your negligence, willful misconduct, or breach of these Terms.

9. Intellectual Property

All content on the Site (text, images, logos) is owned by J.A.Y. Construction LLC or used with permission. You may not reproduce or distribute any material without our prior written consent.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the state or federal courts located in Ocean County, New Jersey.

11. Modification of Terms

We may update these Terms & Conditions at any time by posting the revised version on the Site with a new “Last Updated” date. Continued use after changes constitutes acceptance.
